Terms and Conditions for reservations and bookings through agents

Contractual basis of your reservations / bookings

a. The Terms and Conditions shall apply in relation to Nexxchange GmbH, Vienna, for bookings through the Nexxchange booking system (briefly “Nexxchange System”) by you as agent (for example, a travel agency, tour operator, online broker, hotel). The offers shown in the respective reservation books are available for online booking. 

b. In accordance with your booking inquiry, the available products with the applicable prices will be shown for the times chosen. The Nexxchange system shows, for different product providers and for various product categories, the individual prices for the day concerned. 

Binding offers for the booking selected by you will show the end customer price in the settlement currency of the product provider/operator. The display of this price in other currency is provided for information only and without commitment; therefore, exchange rates may vary. 

Nexxchange provides you with the opportunity to book services of third parties (“Product Providers”) through he Nexxchange system. Nexxchange assumes no obligation for the provision of the booked services; the booked services are to be provided exclusively by the third party provider. With the booking, a contract is formed between you and Nexxchange therefore only for intermediary services, pursuant to which Nexxchange acts only as messenger between you and the third party provider for the forwarding of declarations.

a. Each booking will be forwarded by Nexxchange as messenger, on your behalf, to the booked product provider. For the smooth processing of your booking it is necessary therefore that the data entered by you (e.g. data of the requested tee time, contact data, payment data) be correct and complete.  

b. The intermediary services of Nexxchange are provided without charge to you. The data respectively  information, as to which services are available, the time of their availability, and the price charged for same, are made available by the product provider concerned; Nexxchange does not accept any liability or obligation to provide services in this regard.  

a. With the booking, the contract for the services concerned is formed directly between you and the product provider booked by you. The rights and obligations obtaining from the booking, and the contract resulting therefrom, exist directly between you and the product provider booked by you. 

b. The products are booked directly in the system, the booking is shown in the booking overview and is valid without a separate booking confirmation. The booking overview appears already on the screen and will be shown to you on the portal. 

c. The specific prices and payment conditions are to be agreed directly between the product provider and you as agent. 

The cancellation respectively booking conditions concerned may provide for a cancellation fee. The cancellation respectively booking conditions are agreed between the golf course operator and you as agent when the booking is made through the Nexxchange System.

All changes and cancellations, if permitted, should be made through the Nexxchange System. Cancellations made through the Nexxchange System will be passed on to the product provider and will be confirmed immediately. The timely receipt of the notice by Nexxchange shall be relevant for the timeliness of the change or cancellation. 

Nexxchange collects, processes and uses only those of your data required for the provision of the services of Nexxchange, the use and the operation of the Nexxchange websites, and/or the services offered on the Nexxchange websites. Your data and your customers’ data will be transmitted to third parties only to the extent required for a booking/reservation with the product provider chosen by you; otherwise, these data will not be forwarded to third parties. Nexxchange does not sell or lease the data forwarded by you to third parties. 

The Nexxchange Agreement for Agents shall be subject to Austrian law, to the exclusion of provisions referring to foreign law. The courts with subject matter jurisdiction and with local jurisdiction with respect to the third district of Vienna shall have exclusive jurisdiction with respect to any dispute arising out of or in connection with this Nexxchange Agreement for Agents. 

At the time of a booking of an agent with a product provider, it is to be agreed that only the law applicable at the seat of the product provider, to the exclusion of provisions referring to foreign law, shall apply to the legal relations between the respective product provider and the agent, and that the courts with subject matter jurisdiction and with local jurisdiction at the seat of the product provider shall have exclusive jurisdiction with respect to any dispute arising out of or in connection with the booking made by the agent with the product provider concerned.

The use of the Nexxchange websites and of Nexxchange content is permissible only for the individual retrieval of booking opportunities and for effecting bookings; any other use is not permitted. The data on this website are subject to copyright protection.
